I. Validity
1. All our supplies and achievements exclusively take place on the basis of these trading conditions. By these conditions deviating regulations, in particular also trading conditions of the buyer, become effective only by our written confirmation.

II. Conclusion of a contract
1. In catalogs, price lists and similar documents the contained, and the product-describing data, in particular delivery time and price given with an other offer, are not-binding, as far as they are called not expressly obligatory.
2. The order signed by the buyer is binding. With orders by the Internet, with verbally by telephone or personally given orders, the sending off, and/or the discussion of the order is binding. We are entitled to accept the contract offer lying in it within four weeks after receipt by forwarding of a confirmation of order. Distribution and rendering of invoice stand for our written confirmation of order directly. This period applies likewise to commodity (see number IV, paragraph 2.).

III. Prices
1. All indicated prices are in Euro, excluding postage costs, packagings or insurance. Our prices are not-binding and can be changed without special report at any time. This meets in particular for commodity (see number IV, paragraph 2.) too. The prices are tax-free according to § 19 UstG.
2. As far as between conclusion of a contract and agreed upon and/or actual delivery date are more than six months laying, those apply at present for the supply or supply of valid prices of the salesman; if the latter prices exceed agreed upon the first around more than 10%, then the buyer is entitled to withdraw from the contract.

IV. Supply and payment
1. Supplies take place only by payment in advance or cash on delivery and in principle within four weeks in the inland. The intermediate sale is reserved. It exists for no article delivery obligation. We are entitled to partial deliveries. Supplies take place in high-quality folding boxes, for which we must raise proportionate packing costs. The dispatch takes place at expense and danger of the orderer. Any taxes, customs charges, deliveries etc. go debited to the orderer.
2. Commodity are all articles, which are not marked with „GO“ before the article number. The delivery times and availabilities for commodity are not influenceable by us.
3. If we turn out for reasons, which we have to represent, in delay, then the compensation adhesion is impossible in the case of usual negligence, if the delay was not based on injury of substantial contract obligations.
4. If the buyer sets us, after we are guessed/advised already in failure to deliver, an appropriate respite with refusal menace, then it is entitled at fruitless operational sequence of this respite to withdraw from the contract or to require compensation because of default, the latter however only, if the delay were based to negligence on resolution or rough negligence or in the case more easily on the injury of substantial contract obligations.
5. If the buyer comes into default of acceptance or if it hurts other obligations to cooperate, then we are entitled to require us developing damage including any multi-expenditures. Into this case also the danger of a coincidental fall or a coincidental degradation of the purchase thing changes in the time on the buyer, in whom this turns out in default of acceptance.
6. Calculations are to be settled without departure within 10 days. A calculation departure is permissible only after previous consultation.
7. we compute equipment of the buyers with the payment in delay subject to the asserting of large rights interests at a value of 3 % over the respective rate of discount of the German Federal Bank.

V. Reservation of proprietary rights
1. everything our supplies take place under retention of title. Supplied goods remain up to the complete payment our property.
2. If the buyer with a payment is totally or partly in delay, it stops its payments and arises doubts about its solvency or credit-worthiness, otherwise entitled, then it is not any more entitled to have the commodity. We can withdraw in such a case from the contract.

VI. Rights of the buyer because of deficiencies
1. does not have the supplied article the agreed upon condition or is generally suitable not for after the contract the presupposed or the use or has it not the characteristics, which the buyer can expect after the public expressions of the salesman, carries out the salesman in principle for Nacherfuellung by subsequent delivery of a faultless thing. Repeated subsequent delivery is permissible. If double implementation fails again, the buyer knows after his choice the purchase price lowered appropriately or from the contract to withdraw.
2. The period of limitation for the managing requirements amounts to two years starting from delivery of the commodity.
3. Requirements of the buyer on guarantee can be only granted, if the buyer indicates obvious lack within two weeks and hidden lack within six months after supply. Reprimanded articles are to be sent in after previous consultation with us immediately to the conversion free of postage.
4. Catalogs, lists, uniform booklets etc. are excluded from the conversion.

VII. Other agreements
1. minimum quantities or lower-quantity surcharges are not raised. Collective orders of us personally admitted combinations and groups of collecting tanks can with special conditions be negotiated in individual cases.
2. Each figure illustrated in the catalog is individually available, exceptions of it is specially characterized.
3. Errors in price lists, catalogs, uniform booklets etc. excepted.
4. If individual regulations of these trading conditions should be totally or partly ineffective or become, then the validity of the remaining conditions is not affected thereby.
5. Hereby all previous trading conditions lose their validity.

VIII. Health care advice
1. Our figures contain lead and my be harmful to health, if swallowed.
The exact alloy is Sn55Pb40Sb5 (tin 55%, lead 40%, antimony 5%).
